Protecting Loved Ones

Preserving Eligibility.

Planning for the Future.

At Executive Estate Plans, we understand that estate planning for individuals with special needs requires extra care, knowledge, and compassion. Our goal is to help families provide for their loved ones while maintaining access to essential public benefits such as SSI (Supplemental Security Income) and Medicaid.

We specialize in creating Special Needs Trusts and Miller Trusts (Income-Only Trusts) designed to protect assets, manage funds responsibly, and ensure your loved one’s quality of life—without jeopardizing their eligibility for government assistance programs.

Our experienced professionals guide you through every step, providing the clarity, compassion, and expertise you deserve.

What Is a Special Needs Trust?

Estate planning allows you to make important decisions before they become urgent. Without a plan, Arizona law — not you — determines how your estate is handled. Creating a personalized plan ensures your property, finances, and healthcare choices reflect your true intentions.

An estate plan can help you:

Protect your assets for your family and loved ones

Avoid costly court proceedings or probate delays

Name guardians for minor children or dependents

Appoint trusted individuals to handle your affairs if you’re unable to

Minimize taxes and maximize what you pass on

Provide for family members with special needs or unique circumstances

Leave a lasting charitable legacy

What Is a Miller Trust
(Income-Only Trust)?

Smiling Senior Woman

A Miller Trust, also called a Qualified Income Trust (QIT), is used when an individual’s income slightly exceeds the limit for Medicaid long-term care eligibility.

By channeling excess income into the trust, the person remains eligible for essential Medicaid benefits such as nursing home or in-home care coverage.

Our attorneys ensure your Miller Trust is drafted properly, funded correctly, and administered in full compliance with Arizona’s Medicaid (ALTCS) requirements.
