Power of Attorney

A Power of Attorney (POA) is one of the most important legal tools in any estate plan. It allows you to appoint a trusted individual—known as your agent or attorney-in-fact—to make financial, legal, or medical decisions on your behalf if you become unable to do so yourself.

Protecting Your Interests and Ensuring Trusted Decision-Making

A Power of Attorney (POA) is one of the most important legal tools in any estate plan. It allows you to appoint a trusted individual—known as your agent or attorney-in-fact—to make financial, legal, or medical decisions on your behalf if you become unable to do so yourself.

At Executive Estate Plans, we help clients establish Powers of Attorney that safeguard their interests, provide clarity for loved ones, and ensure that their wishes are honored—no matter what the future holds.

What Is a Power of Attorney?

A Power of Attorney is a legal document that grants someone the authority to act on your behalf. This can be for specific tasks, like managing a bank account or selling property, or for broad powers that include handling all financial and healthcare matters.

Without a valid POA in place, your family may need to go through a lengthy and costly court process to make even basic decisions for you if you become incapacitated. Having the right Power of Attorney ensures that the person you trust is legally empowered to manage your affairs seamlessly.

Why You Need a Power of Attorney

A well-drafted Power of Attorney provides peace of mind and protection. It helps avoid confusion, delays, and unnecessary legal battles during times of illness or incapacity. With a POA, you maintain control—because you decide who acts on your behalf and how they can act.

At Executive Estate Plans, we tailor each Power of Attorney to your personal, family, and financial circumstances. We ensure that your documents are clear, legally sound, and recognized by the institutions and professionals you rely on.

Types of Power of Attorney

Different situations call for different types of Powers of Attorney. Understanding the distinctions helps ensure you choose the right one for your needs.

Durable Power of Attorney (Financial POA)

A Durable Power of Attorney allows your agent to handle financial matters such as paying bills, managing investments, or selling property. The word “durable” means it remains valid even if you become incapacitated.
This is essential for maintaining financial stability and avoiding court intervention if you’re unable to make decisions on your own.

Healthcare Power of Attorney (Medical POA)

A Healthcare Power of Attorney designates someone to make medical decisions on your behalf if you cannot communicate your wishes. This person works closely with your healthcare providers and ensures your preferences for treatment and care are respected.

General Power of Attorney

A General POA gives broad authority to your agent to act in nearly all legal and financial matters. However, it typically ends if you become incapacitated or pass away—making it most useful for temporary or specific situations, like handling business while you’re out of the country.

Limited (or Special) Power of Attorney

A Limited POA grants your agent authority for a specific purpose or time period. For example, you might use it to authorize someone to sign documents for a real estate transaction or manage certain accounts while you’re unavailable.

Springing Power of Attorney

A Springing POA only “springs” into effect under certain conditions—usually when you become incapacitated and can no longer make decisions for yourself. This type can offer reassurance that control only transfers when absolutely necessary.
